A Word About Cost Recovery Fees
The U.S. Freedom of Information Act (FOIA) is a law ensuring public
access to U.S. government records. FOIA carries a presumption of
disclosure; the burden is on the government—not
the public—to substantiate why information may
not be released. Upon written request, agencies of the United States
government are required to disclose those records unless they can be
lawfully withheld from disclosure under one of nine specific exemptions in
the FOIA. This right of access is ultimately enforceable in federal

Over 30 years after the events that led to Mr. Peltier's wrongful
conviction and imprisonment, the Federal Bureau of Investigation (FBI)
continues to withhold 157,843 (or more) case-related documents. Attorneys
for Mr. Peltier have had to repeatedly and often petition the federal
courts to gain the release of these documents. In addition, because such
files are not necessarily centralized, Mr. Peltier's attorneys have had to
file separate FOIA actions around the country to obtain documents withheld
by the various FBI Field Offices.
These legal actions are costly enough, but those expenses pale compared to
the funds required to obtain these case documents so critical to Mr.
Peltier's defense. Cost recovery (duplication) fees charged by federal
government agencies—currently $0.10/page—are
mandated under the "Reinventing Government" initiative begun during the
1990s. Therefore, any of the 157,843 or more documents released by the FBI
will come at a cost ($15,000+ and that in addition to other legal expenses incurred
by Mr. Peltier for FOIA actions, as well as other legal strategies—including unrelated federal appeals
and civil suits, upcoming parole actions, and the outstanding
petition for clemency being employed to win
Mr. Peltier's freedom.
